Abstract

This study aims to examine the legal foundations for criminalizing human cloning in Tunisia, the UAE, Egypt, Algeria and Iraq . Its significance arises from a comparative review of Arab legislation about human cloning from a criminal policy perspective. The findings indicate that Iraq’s lack of clear legislation creates a legal vacuum that may enable unregulated practices, potentially leading to the exploitation of cloning technology for illicit purposes. The study advocates for the enactment of explicit Iraqi legislation prohibiting human cloning, reinforced by stringent criminal penalties to prevent the misuse of this technology. Furthermore, it calls for enhanced cooperation among Arab nations to establish a unified legal framework governing cloning technologies, thereby safeguarding ethical and societal values from potential violations.
